Taiwan NAND flash makers turn soft over SanDisk lawsuit

Of the 25 companies sued by SanDisk over NAND flash-related patent infringement, one first-tier NAND flash controller chip maker Afa Technologies (Afatech) recently announced it has settled with SanDisk, while many other memory module and controller chip makers have also expressed willingness to reach a settlement if SanDisk offers favorable conditions, according to industry sources.

Both SanDisk and the sued NAND flash-related makers have been greatly impacted by the cost of continuing the case in the courts and dropping NAND flash pricing, therefore the both sides are looking for a way out, the sources explained.

In the settlement between SanDisk and Afatech, SanDisk only asked Afatech to change the design of its controller chip and did not demand any penalties, according to the companies, but there could be some inside agreement not made public, noted the sources.

However, controller chip makers settling with SanDisk does not solve the issue, if their clients do not follow suit, since the lawsuit involves both controller chips and finished products, the sources added.
